These Terms of Use (“Terms”) govern your use of TripsWallet (“TripsWallet”, the “App”), provided by A8 ON Studio (“A8 ON Studio”, “we”, “our”, or “us”). By downloading, accessing or using TripsWallet, you agree to these Terms. If you do not agree to these Terms, you should not use the App.
1. About TripsWallet
TripsWallet is a travel planning and organisation application designed to help users organise trips, itineraries, transportation, accommodation, activities, travel documents, reminders, budgets, notes and other travel-related information.
TripsWallet is an organisational tool. It is not a travel agency, airline, accommodation provider, immigration adviser, financial adviser, insurance provider or government service.
2. Your Responsibility
You are responsible for the information you enter, import, store or rely upon in TripsWallet and for independently verifying information that may affect your travel.
You should confirm important information directly with the relevant airline, accommodation provider, transport operator, government authority, insurer or other authoritative source before relying upon it.
This includes, without limitation, flight times, reservations, check-in requirements, passport validity, visas, immigration requirements, health requirements, travel restrictions, insurance coverage, prices, exchange rates and transportation arrangements.
3. Travel Documents and Important Information
TripsWallet may allow you to store or organise important travel documents and information. The App should not be treated as the sole or authoritative repository for documents required for travel.
You are responsible for retaining appropriate originals, official copies or independent backups of passports, visas, tickets, boarding passes, reservations, insurance documents and other important travel records.
4. Imported and Recognised Information
TripsWallet may provide features that help import, scan, recognise, extract or organise information from documents, photographs, boarding passes, confirmations, receipts or other material.
Automated recognition, optical character recognition, parsing and similar functionality may produce incomplete or inaccurate results. You are responsible for reviewing and confirming imported or recognised information before relying upon it.
5. Maps, Locations and Journey Information
Maps, geographic locations, routes, journey paths and other location-related information displayed by TripsWallet are provided for organisational and informational purposes.
Location information may be approximate, incomplete or affected by information supplied by you or by third-party mapping services. TripsWallet should not be used as a substitute for appropriate navigation, safety advice or official travel information.
6. Reminders and Notifications
TripsWallet may provide reminders and notifications relating to information stored in the App.
Delivery of notifications may depend on device settings, operating system behaviour, permissions and other circumstances outside our control. You should not rely exclusively on TripsWallet notifications for time-critical travel obligations.
7. Your Content
You retain ownership of content that you create, import or store using TripsWallet.
You are responsible for ensuring that you have the necessary rights and permissions to store, import or share any content you use with the App.
You must not use TripsWallet to store, distribute or share content in violation of applicable law or the rights of another person.
8. Collaboration and Sharing
TripsWallet may allow you to share selected trip information or collaborate with other users through supported Apple services.
You are responsible for deciding whom you invite and what information you choose to share. People with access to shared information may be able to view or modify that information according to the permissions provided by the applicable service.
We are not responsible for actions taken by people whom you choose to invite or for information subsequently used, copied or disclosed by those participants.
9. Apple and Third-Party Services
TripsWallet may rely on services and technologies provided by Apple or other service providers, including services associated with iCloud, CloudKit, Maps, notifications, the App Store and device operating-system functionality.
Availability and operation of those services are outside our direct control and may be governed by separate terms and privacy policies.
We do not guarantee the continued availability, accuracy or uninterrupted operation of any third-party service.
10. Purchases and Premium Features
TripsWallet may offer optional paid functionality, including subscriptions, lifetime purchases, Trip Passes or other in-app purchases.
The price and scope of a purchase will be displayed before you confirm the transaction. Purchases made through the App Store are processed by Apple and are subject to Apple's applicable terms and purchase policies.
Unless otherwise required by applicable law, billing, payment processing and refunds for App Store purchases are administered by Apple.
11. Subscriptions
If TripsWallet offers an auto-renewable subscription, payment will be charged through your Apple account according to the terms presented when you purchase the subscription.
Subscriptions may automatically renew unless cancelled in accordance with Apple's subscription-management requirements. You can manage or cancel subscriptions through your Apple account settings.
Deleting TripsWallet does not necessarily cancel an active subscription.
12. Lifetime Purchases
A “Lifetime” purchase, where offered, means access to the TripsWallet features designated as included with that purchase for the commercially supported lifetime of the applicable TripsWallet product or service. It does not guarantee that the App, every feature, or compatibility with every future device or operating system will exist indefinitely.
Nothing in this section limits rights you may have under applicable consumer law.
13. Trip Passes
TripsWallet may offer a Trip Pass or similar purchase that unlocks specified functionality for an individual eligible trip. A Trip Pass is not the same as a subscription or a global Premium entitlement unless expressly stated at the time of purchase.
The features, eligibility and scope associated with a Trip Pass will be described in the App before purchase.
14. Changes to Features and Pricing
We may modify, improve, add or discontinue App features over time. We may also change pricing for future purchases or subscription periods, subject to applicable law and Apple's requirements.
Changes will not remove statutory rights that cannot lawfully be excluded.
15. Data Storage and Backups
TripsWallet may store information locally on your device and may use Apple services such as iCloud or CloudKit for supported synchronisation, backup or collaboration functionality.
No storage or synchronisation system can guarantee against all forms of data loss, corruption, deletion, service interruption or device failure.
You are responsible for maintaining independent copies of information and documents that are important to your travel.
16. Availability
We aim to provide a reliable App, but TripsWallet is provided subject to the inherent limitations of software, devices, networks and external services.
We do not guarantee that the App will always be available, uninterrupted, error-free, compatible with every device or operating-system version, or free from defects.
17. Acceptable Use
You must not misuse TripsWallet or attempt to interfere with its normal operation.
You must not use the App for unlawful purposes, attempt to gain unauthorised access to systems or information, deliberately circumvent security or purchase controls, reverse engineer the App except where expressly permitted by law, or use TripsWallet in a manner that infringes the rights of others.
18. Intellectual Property
TripsWallet, including its software, interface, design, branding, graphics and other original material supplied by A8 ON Studio, is protected by applicable intellectual-property laws.
Except for your own content and material belonging to third parties, no ownership rights in TripsWallet are transferred to you.
You receive a limited, personal, non-exclusive, non-transferable right to use the App in accordance with these Terms and the applicable App Store terms.
19. Privacy
Your use of TripsWallet is also subject to our Privacy Policy, which explains how information is handled by the App.
20. Suspension or Termination
We may restrict or discontinue access to TripsWallet or particular services where reasonably necessary for security, legal compliance, prevention of misuse, technical reasons or discontinuation of a service.
You may stop using TripsWallet at any time. Your rights relating to paid purchases remain subject to applicable law and Apple's applicable terms.
21. Disclaimer
To the extent permitted by law, TripsWallet is provided on an “as available” basis. Information presented or organised by the App is provided as an aid to travel planning and should be independently verified where accuracy is important.
We do not warrant the accuracy of information supplied by users, travel providers, external services or automated recognition processes.
22. Limitation of Liability
To the maximum extent permitted by applicable law, A8 ON Studio will not be liable for indirect, incidental, special, consequential or economic loss arising from your use of, or inability to use, TripsWallet, including losses arising from inaccurate information, missed travel arrangements, data loss, device failure, service interruptions or actions of third parties.
You remain responsible for making and confirming your travel arrangements and for maintaining appropriate copies of essential travel information.
23. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights available under the Australian Consumer Law.
Where our liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.
24. International Users
TripsWallet may be available in multiple countries and regions. You are responsible for complying with laws applicable to your use of the App in your location.
Mandatory consumer or privacy rights applicable in your country or region are not excluded by these Terms where they cannot lawfully be excluded.
25. Changes to These Terms
We may update these Terms from time to time to reflect changes to TripsWallet, legal requirements or our business practices.
The current version will be made available through our official website and/or the App. Where required by applicable law, we will provide appropriate notice of material changes.
26. Governing Law
These Terms are governed by the laws applicable in South Australia, Australia, without limiting any mandatory rights you may have under the laws of your country or region.
27. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
